The simple fact that they are making profit off of an idea, an image, a name that isn't theirs.

would be the same as someone selling "air jordans" that were not liscensed by nike.

I just love how they put "support your favorite band" as if the guys are getting any profit! rolleyes.gif

I don't think there's enough there for them to be breaking any sort of law or anything so...I don't know. Maybe. I wish we could somehow contact the guys and ask if they approve.

It's cute, but it would be nice if all the pins were the same size. dry.gif

Yeah this came up in the toy world before in a licensing issue. You can't take a company's patches and officially produced images and put them on another object like a hat or shirt and then sell it. They would have to license a specific product produce a sample get approval then manufacture it. Its up to Virgin to shut these down though. If no one stops them or sues them then they can just keep doing it of course.

Thats weird, not denying it just wondering because a friend of mine has his stuff sold there and they licensed images from him and he got a fee for a set amount of things made. He makes a fee for each batch they make other than that they keep the profit on the stuff itself. I guess the more the stuff sells the more fees they pay for batches made, they can't just keep making more and more things of his but pay a fee per re-ordered batch. Well thats how it was explained to me so maybe Virgin gets a fee somewhere in there.

The more stuff made and sold by "unauthorized" people the less people will order from licensed sources.. anyway I am probably getting some of this wrong but its licensing issues not exactly profits on shirts sold.. all I know is auctions were shut down once when people put doll patches on hats and tried to sell them. They sued to be able to sell them and lost and ebay has a service companies can subscribe to to have auctions like this shut down. If Virgin doesn't care then its no big deal.

What happens with Hot Topic is that Gap (their owner), makes a deal with the record label to design exclusive stuff. It never goes through the band, always with the label and Gap only. THUS, why whenever you find a band shirt in Hot Topic, you'll never be able to find that same shirt on a bands official merch page.

Not to say I disagree with you husband, because I used to work at HT 4 years ago and I learned a lot about their business dealings.

But as far as "whenever you find a band shirt in Hot Topic, you'll never be able to find that same shirt on a bands official merch page. ", there's a couple bands I'm friends with who have shirts for sale at HT that they also have for sale at their shows and on their sites and such. But that's like...5 bands out of the list so god knows what goes on with the rest of them.

And I remember when I learned that Gap owns Hot Topic. It was shortly after I quit working there. And I've been severely disillusioned since then.

I checked the NASDAQ listings, and Hot Topic is Hot Topic's owner. The Gap owns Old Navy though. Other than that, Hot Topic is still a shitty trendy clothing store.
